Terms of Service

1) Overview

These Terms of Service (“Terms”) govern your access to and use of NodeCrest and related websites, dashboards, APIs, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

No affiliation: NodeCrest is not affiliated with Mojang or Microsoft (Minecraft), or Electronic Arts or any of their subsidiaries. All marks and game content remain the property of their respective owners.

2) Your Account

• You must provide accurate information and keep it current.
• You are responsible for all activity under your account and for maintaining the confidentiality of credentials and tokens.
• Where third-party logins are used (e.g., Discord, Minecraft), you authorize us to receive the basic profile data necessary to authenticate you.
• Do not share your account or impersonate others.

3) Eligibility

• You must be able to form a binding contract. If you are under the age required by your jurisdiction, you must have parental/guardian consent.
• If you use the Service on behalf of an entity, you represent that you have authority to bind that entity.

4) Services & Access

• We may update, suspend, or discontinue features at any time to maintain security, reliability, or legal compliance.
• We may impose technical limits (e.g., slots, storage, bandwidth, rate limits) and take reasonable steps to enforce them.
• We may refuse, revoke, or restrict access where use is abusive, harmful, or unlawful.

5) Subscriptions & Billing

• Paid plans, if offered, are billed in advance on a recurring basis unless otherwise stated.
• Taxes may apply based on your billing address and applicable law.
• You authorize us and our payment processor to store your payment method and charge it per your plan.
• Changes to pricing will be notified in advance and take effect on your next billing cycle unless you cancel.

6) Refunds

• Except where required by law, fees are non-refundable. If a specific money-back guarantee is advertised, it applies as described there.
• Partial-period refunds are not provided unless mandated by applicable consumer laws.

7) Acceptable Use

You agree not to:

• Violate any law, infringe IP rights, or breach third-party terms (e.g., game EULAs or network rules).
• Harass, dox, defame, or distribute malware, phishing, or unauthorized scraping.
• Interfere with Service integrity, perform stress tests without consent, or circumvent limits, security, or authentication.
• Use the Service for spam, unauthorized commercial communications, or child sexual abuse material (CSAM)—zero tolerance.

8) User Content

• You retain ownership of content you upload, transmit, or host through the Service.
• You grant NodeCrest a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and back up your content solely to operate and improve the Service.
• You are responsible for obtaining rights and complying with third-party licenses for content you use or host.

9) Intellectual Property

• The Service (including software, design, and branding) is owned by NodeCrest or its licensors and is protected by law.
• Except as permitted by open-source licenses we provide, you may not reverse engineer, decompile, or create derivative works of the Service.

10) APIs & Rate Limits

• API keys are personal to your account. Keep them secret and rotate if compromised.
• We may set and adjust rate limits. Exceeding limits may result in throttling or suspension.
• You must not proxy or resell API access without written approval.

11) Beta & Experimental Features

Beta features may be unstable, incomplete, or withdrawn at any time. They are provided “as is,” and usage may be subject to additional terms or limits.

12) Availability; Support

• We strive for reliable uptime, but downtime and maintenance may occur.
• Support channels and response targets may vary by plan and region.

13) Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You are responsible for appropriate backups and security configurations.

14) Limitation of Liability

To the maximum extent permitted by law, NodeCrest and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption. Our total liability for any claim relating to the Service will not exceed the greater of (a) AUD $100 or (b) the amounts you paid to us for the Service in the 3 months preceding the event giving rise to liability.

15) Indemnity

You agree to indemnify and hold NodeCrest harmless from claims arising out of your content or your use of the Service in violation of these Terms or applicable law.

16) Suspension & Termination

• You may stop using the Service at any time. For paid plans, cancellation takes effect at the end of the current term unless otherwise stated.
• We may suspend or terminate access immediately for violations, risk to the Service, legal requests, or non-payment.
• Upon termination, your right to access the Service ends. Certain clauses reasonably surviving termination will continue to apply.

17) Governing Law

These Terms are governed by the laws of the State of Victoria, Australia, and the courts of Victoria have exclusive jurisdiction, except where local consumer laws require otherwise.

18) Changes to these Terms

We may modify these Terms. If changes are material, we will provide reasonable notice (e.g., via the dashboard or email). Continued use after the effective date constitutes acceptance.
